H Function Procedure of handling of bill

  • Submission, proposition or introduction of bill
    • Submitted by the local head
    • Proposed by committee
    • Motion by more than 1/5 council members or joint signature of more than 10 members
  • Acceptation
    • Confirming requirement
      • form of bill
      • names of agreed
      • members
  • Granting bill number
    • Number is granted just by the order without concerning of sorts
  • Report to Chairman
    • By concerned standing committee with regulations
  • Printing bill
    • Council members proposed: by office
    • Committee proposed: by committee
    • Local head proposed: by concerned department
  • Distribution of bill and report to main session
    • One copy for each council member
    • During session, report it immediately. In other case, report to committee first and then report it the first day of main session
  • Sending to standing committee
    • Sending to concerned committee
  • Standing committee deliberation
    • Report to committee
    • Decide schedule
    • Explain about bill
    • Review and report
    • Question and answer
    • Discussion
    • Discuss article by article
    • Hearing from local government
    • Vote
  • Report the result of committee deliberation
    • Report to chairman by official document
  • Main session deliberation
    • Decide schedule
    • Report about committee deliberation by committee chairman or member

  • (For ordinance bill) Send to local head
    • Budget: Within 3 days
    • Ordinance bill: Within 5 days
    • Other bill should be sent as soon as possible
  • Proclamation from local head
    • After sending, the local head must proclaim within 20 days
    • If not, chairman does it instead
    The council accepts Notice of proclamation
    1. Make an Objection
      • If there is problem, the local head can make an objection with proper reasons within 20 days after got it
    2. Acceptance
    3. Handling in main session
      • Decide schedule (If there is not special reason, it must be within 10 days except closing session)
      • Hearing reasons of objection from local government
      • Question
      • Discussion
      • Vote
  • Send to the local head
  • The local head proclaims
    • After sending, the local head must proclaim within 5 days
    • If not, chairman does it instead
    Appeal to the Supreme Court
    • If re-voted bill is considered to violate the law, the local head can appeal within 20 days from voting
